The Waiver

NEXUS BATTLEFIELD LLC

PARTICIPANT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

In consideration for being permitted to participate in activities provided by Nexus Battlefield LLC, I acknowledge and agree to the following:

Activities and Assumption of Risk

I understand that Nexus Battlefield LLC provides mobile recreational activities that may include King’s Clash foam sword and shield combat, mobile axe throwing, target games, paintball or splatter-art activities, physical competitions, event challenges, and other recreational activities or add-ons.

I understand that participation involves inherent and other risks, including slips, trips, falls, collisions, cuts, bruises, strains, sprains, fractures, accidental contact with equipment or other participants, falling or bouncing objects, uneven outdoor terrain, weather conditions, equipment failure, physical exertion, serious bodily injury, property damage, disability, and, in rare circumstances, death.

I voluntarily choose to participate and knowingly assume the risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.

Safety Rules

I agree to follow all instructions and safety rules given by Nexus Battlefield staff. I understand that head and neck strikes, thrusting or stabbing movements, excessive force, horseplay, and intentionally dangerous conduct are prohibited during King’s Clash. Axes and other throwing equipment may only be used and retrieved as directed by Nexus Battlefield staff and within designated throwing areas. Closed-toe shoes are required for axe throwing, and any required safety equipment must be worn when instructed.

Nexus Battlefield LLC may immediately stop or refuse my participation if staff believe my conduct, physical condition, impairment, or failure to follow instructions creates an unsafe condition. Removal for unsafe conduct may occur without refund.

Physical Condition and Impairment

I understand that Nexus Battlefield activities may involve running, throwing, bending, twisting, blocking, rapid movement, physical exertion, and contact with equipment or other participants. I am responsible for determining whether I am physically able to participate safely and will notify staff of any limitation that may affect my participation.

I agree not to participate while impaired by alcohol, illegal drugs, medication, or any other substance or condition that could interfere with my judgment, balance, coordination, or ability to participate safely.

Release and Waiver of Liability

To the fullest extent permitted by applicable law, I voluntarily release, waive, and discharge Nexus Battlefield LLC, its owners, members, employees, contractors, representatives, event hosts, agents, volunteers, affiliates, equipment providers, and participating property owners or event hosts from claims arising out of or relating to my participation in Nexus Battlefield activities.

This release is intended to include claims involving the ordinary risks associated with participation and, to the extent permitted by applicable law, claims arising from ordinary negligence. This waiver does not waive any rights or claims that cannot legally be waived under applicable law.

Responsibility for Conduct and Property

I accept responsibility for injuries, damage, or losses caused by my intentional, reckless, or unsafe conduct. I agree not to intentionally damage Nexus Battlefield equipment or other property and understand that I may be responsible for the reasonable cost of repairing or replacing equipment that I intentionally damage or misuse.

Emergency Medical Authorization

If I am injured or experience a medical emergency and am unable to provide consent, I authorize Nexus Battlefield LLC staff to contact emergency medical services and take reasonable steps to obtain emergency assistance. I understand that Nexus Battlefield LLC does not provide medical insurance for participants and that I am responsible for resulting medical expenses except where otherwise required by law.

Event Location and Weather

I understand that Nexus Battlefield is a mobile entertainment company and activities may take place at private residences, parks, schools, businesses, event venues, fields, parking areas, or other locations. Nexus Battlefield may modify, pause, relocate, or discontinue an activity if staff determine that weather, location conditions, equipment, participant behavior, or another circumstance creates an unreasonable safety concern.

Minors

If I am signing as the parent or legal guardian of a minor participant, I represent that I have legal authority to consent to the minor’s participation. I acknowledge the nature and risks of the activities, give permission for the minor to participate, and agree to the acknowledgments, assumptions of risk, and releases contained in this waiver on behalf of myself and, where legally permitted, on behalf of the minor participant.

Electronic Signature and Acknowledgment

I agree that my electronic signature or digital acceptance of this waiver has the same force and effect as a handwritten signature to the extent permitted by law.

By signing through Bookeo, I confirm that the participant information I provide is accurate, that I have read and understood this waiver, understand that participation involves risks, have had an opportunity to ask questions, understand that I am giving up certain legal rights, and voluntarily agree to its terms.

If any provision of this waiver is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
