Welcome to Nexus Battlefield LLC (“Nexus Battlefield,” “we,” “our,” or “us”). These Terms and Conditions govern your use of our website, booking services, purchases, and participation in Nexus Battlefield experiences.

By accessing our website, making a reservation, purchasing an experience, or participating in an event, you agree to these Terms and Conditions.

1. Our Services

Nexus Battlefield provides mobile entertainment experiences in Colorado, which may include:

- King’s Clash foam combat experiences
- Mobile axe throwing
- Combination packages
- Specialty game modes and upgrades
- Fire performances
- Paintball splatter art experiences
- Additional entertainment services and activities offered from time to time

Specific activities, durations, group sizes, equipment, pricing, and availability may vary by package and location.

2. Booking Requirements

The person making a reservation must be at least 18 years old and legally authorized to enter into an agreement on behalf of the booking party.

Customers are responsible for providing accurate information when making a reservation, including:

- Contact information
- Event address
- Event date and time
- Expected number of participants
- Participant age ranges when requested
- Information regarding the event site or property that may affect setup or safety

Providing incorrect or incomplete information may affect our ability to provide the booked service.

3. Payments

Prices and payment requirements are displayed during the booking process.

Customers authorize Nexus Battlefield and its payment providers to charge the payment method supplied for all authorized booking charges.

Additional charges may apply for approved upgrades, additional time, travel fees, damage, or other services requested by the customer.

Payment transactions may be processed by third-party providers.

4. Cancellations, Rescheduling, and Refunds

Cancellation, refund, rescheduling, and deposit requirements applicable to a specific reservation will be disclosed during the booking process.

Unless otherwise stated in the applicable booking policy, payments and deposits may be non-refundable after certain deadlines due to staffing, travel preparation, equipment allocation, and the reservation of your event time.

Nexus Battlefield may, at its discretion, allow an event to be rescheduled when sufficient notice is provided.

Failure to attend an event or provide an appropriate event location does not automatically entitle the customer to a refund.

5. Weather and Outdoor Conditions

Many Nexus Battlefield experiences take place outdoors.

Weather conditions may affect the safety or feasibility of an event. Nexus Battlefield reserves the right to delay, modify, reschedule, relocate, or cancel an activity when weather or environmental conditions create an unreasonable safety risk.

Examples may include:

- Lightning
- Severe storms
- Excessive wind
- Dangerous temperatures
- Fire restrictions
- Unsafe ground conditions
- Other hazardous weather or environmental conditions

Safety decisions made by Nexus Battlefield staff during an event are final.

6. Event Location and Customer Responsibilities

The customer is responsible for ensuring that Nexus Battlefield has permission to operate at the selected event location.

The customer must provide an appropriate, reasonably safe area for setup and operation of the booked experience.

Customers are responsible for informing Nexus Battlefield before the event of conditions that could interfere with setup or safe operation, including limited access, steep terrain, underground irrigation, restricted parking, property rules, or similar issues.

Nexus Battlefield may refuse to set up or operate equipment when the location presents an unreasonable safety risk.

7. Participant Waivers

Certain Nexus Battlefield activities require participants to complete a liability waiver before participating.

Participants who do not complete a required waiver may not participate.

For participants under 18 years of age, a parent or legal guardian may be required to complete or authorize the applicable waiver.

The participation waiver is a separate agreement and may contain additional terms relating to assumption of risk, release of liability, medical treatment, and participant responsibilities.

If there is a conflict between these Terms and a signed participation waiver concerning participation risks or liability, the applicable waiver will control to the extent permitted by law.

8. Safety Rules

All participants must follow instructions provided by Nexus Battlefield staff.

Depending on the activity, safety requirements may include:

- Wearing required safety equipment
- Staying within designated activity areas
- Following weapon or equipment-handling instructions
- Avoiding prohibited strikes or unsafe conduct
- Waiting for staff authorization before beginning an activity
- Following all posted or announced safety rules

Nexus Battlefield may immediately stop a participant from participating if staff reasonably believe that the participant presents a danger to themselves, another participant, staff, equipment, or property.

No refund is required when participation is ended because of unsafe, reckless, threatening, or disruptive behavior.

9. Axe Throwing

Participants in axe throwing must follow all instructions regarding throwing techniques, retrieving equipment, remaining behind safety lines, and entering throwing areas.

Participants may not retrieve axes or other throwing equipment until instructed that it is safe to do so.

Nexus Battlefield may establish minimum age or participation requirements depending on the event and applicable insurance or safety requirements.

10. King’s Clash and Combat Activities

King’s Clash is a recreational foam-combat experience.

Participants must follow Nexus Battlefield combat rules, which may include restrictions on:

- Head and neck strikes
- Excessive force
- Unsafe thrusting
- Tackling
- Wrestling
- Intentional dangerous contact

Nexus Battlefield staff may modify gameplay or remove participants when necessary for safety.

11. Fire Performances

Fire performances involve inherent risks and are conducted only in locations and conditions considered suitable by Nexus Battlefield.

The audience must remain within designated viewing areas and follow all instructions from performers or staff.

Fire performances may be modified or canceled because of weather, fire restrictions, property rules, or other safety concerns.

12. Paintball Activities

Paintball equipment used during Nexus Battlefield experiences must only be used in designated areas and under staff supervision.

Participants must follow all instructions regarding handling, firing, protective equipment, and designated targets.

Paintball guns may not be intentionally fired at people, animals, vehicles, buildings, or other objects unless specifically permitted as part of an approved Nexus Battlefield activity.

13. Alcohol and Drugs

Nexus Battlefield may refuse participation to anyone who appears impaired or whose behavior creates a safety concern.

Participants may not operate or use equipment while impaired by alcohol, illegal drugs, or any substance that affects their ability to participate safely.

The presence of alcohol at an event does not override Nexus Battlefield safety requirements.

14. Children and Minors

Parents and guardians remain responsible for the supervision and behavior of minors attending an event unless otherwise specifically agreed in writing.

Nexus Battlefield staff provide activity instruction and event facilitation but do not provide childcare or general child supervision.

Age restrictions may apply to specific activities.

15. Assumption of Risk

Nexus Battlefield activities may involve physical activity and inherent risks.

Possible risks may include falls, collisions, equipment contact, cuts, bruises, muscle strains, and other injuries associated with recreational activities.

Participation is voluntary.

Participants are responsible for determining whether they are physically capable of safely participating and for informing Nexus Battlefield staff of relevant limitations when appropriate.

Nothing in these Terms is intended to waive rights or responsibilities that cannot legally be waived under applicable law.

16. Personal Property

Participants are responsible for their personal belongings.

Nexus Battlefield is not responsible for lost, stolen, misplaced, or damaged personal property except where liability cannot legally be excluded.

Participants should secure phones, jewelry, valuables, and other loose items before participating.

17. Damage to Nexus Battlefield Property

Customers and participants may be responsible for the reasonable cost of repairing or replacing equipment intentionally damaged, stolen, or damaged through misuse or conduct outside normal participation.

Normal wear resulting from proper participation is not considered customer damage.

18. Photos and Video

Nexus Battlefield may photograph or record certain events for promotional purposes when appropriate.

When separate permission or consent is required, Nexus Battlefield will seek that permission before using identifiable images or recordings.

Customers should notify Nexus Battlefield if there are specific photography restrictions relating to their event.

19. Intellectual Property

The Nexus Battlefield name, logos, branding, game concepts, written materials, graphics, website content, and other original materials are owned by or licensed to Nexus Battlefield LLC unless otherwise stated.

Website content may not be copied, reproduced, distributed, sold, or commercially used without prior written permission.

20. Website Use

You agree not to use our website to:

- Engage in unlawful activity
- Attempt to gain unauthorized access to systems or accounts
- Introduce malicious software
- Interfere with website operation
- Submit fraudulent reservations
- Impersonate another person
- Misuse contact, booking, or payment systems

We may restrict access to the website when misuse is suspected.

21. Third-Party Services

Nexus Battlefield may use third-party providers for website hosting, reservations, payment processing, electronic waivers, communications, analytics, and other services.

Those providers may have their own terms and privacy policies.

Nexus Battlefield is not responsible for third-party services outside our reasonable control.

22. Availability and Changes

We may modify services, packages, equipment, pricing, operating areas, game rules, or availability as the business evolves.

When a material change affects an existing confirmed reservation, we will make reasonable efforts to communicate with the customer.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Nexus Battlefield LLC and its owners, employees, contractors, performers, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services.

Any limitation or release relating specifically to participation in an activity may also be governed by the applicable participation waiver.

Nothing in these Terms excludes liability that cannot legally be excluded under Colorado or applicable federal law.

24. Governing Law

These Terms and Conditions are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any legal dispute arising from these Terms or Nexus Battlefield services will be handled in a court of competent jurisdiction in Colorado unless otherwise required by applicable law.

25. Privacy

Information collected through the website, booking process, and related services is handled according to our Privacy Policy.

26. Changes to These Terms

Nexus Battlefield may update these Terms and Conditions from time to time.

Updated Terms will be posted on our website with a revised effective date.

Changes will generally apply prospectively and will not retroactively change material terms of an existing confirmed reservation unless required by law or agreed by the customer.
